On October 11, 2010, Oklahoma Design Technologies met with Mr. Norris Nicholson with Rural Utilities Service in Washington D.C. to discuss RUS approval of the SAF-T-TORQUE Anchor. A test was performed to determine the pull out strength of the anchor at that location. The anchor was installed and the Anchor Locker/Puller was used to pull the anchor, the anchor began to move at 6,000 pounds. An anchor and test data was provide to Mr. Nicholson at that time.
Mr. Nicholson stated that a borrower can have unlisted materials financed by RUS, as long as the equipment has been approved by RUS on a case-by-case basis. RUS requests a letter or email from the borrower requesting that they would like to purchase the anchors on a test basis to determine if they were suitable for use in their area. At that time, the borrower can begin using the anchors on a limited basis.
Listed below is an example letter/email that can be sent to RUS. Cooperatives should send this letter to their respective Regional Office, either the Northern Regional Division or Southern Regional Division. Below are the mailing addresses for both RUS Regional Offices.
Please accept this letter/email as request that our company purchase the SAF-T-ANCHOR from Oklahoma Design Technologies for testing purposes. Cooperative Name would like to use (# of anchors) associated with (Construction Work Plan, Construction Work Plan Amendment or Specific Time frame).
We understand that the office of Rural Utilities Service – Technical Standards Committee “A” (Electric) is currently in the process of considering this anchor for acceptance into the IP 202-1 List of Materials.

1728.70 PROCUREMENT OF MATERIALS
Here is an excerpt from Regulations 7 CFR 1728.70. The part that refers to cooperatives using unlisted equipment has been highlighted. Also, for reference, these regulations can be found on the RUS website at:
(a) By Owner. When purchasing the type of materials included in the List of Materials, RUS borrowers shall purchase only materials listed in the List of Materials, or materials which have a current technical acceptance by RUS and meet the “Buy American” requirement.
(b) By Contractor. When performing work for an RUS borrower, contractors shall supply only items from the general acceptance pages of the List of Materials, or obtain the borrower's concurrence prior to purchase and use of a technically nondomestic item or any item listed on a conditional basis.
(c) Procurement of Unlisted Items.(1) The borrower shall request prior approval from RUS for use of an item that does not fall in categories established by RUS in the List of Materials for which acceptability has been established by the Technical Standards Committees.
(2) RUS will also determine, on a case-by-case basis, whether to allow use of an unlisted item in emergency situations and for experimental use or to meet a specific need. For purposes of this part 1728, an emergency shall mean a situation wherein the supply of listed material and equipment from the industry is not readily available, or the standard designs are not applicable to the borrower's specific problem under consideration.
(3) RUS will make arrangements for test or experimental use of newly developed items requiring limited trial use. RUS, working with the borrower and the manufacturer, will establish test locations for the items to facilitate installation and observation.
